By accessing, browsing, or using our website, platform, or any related services (collectively referred to as the “Platform”), you acknowledge that you have read, understood, and agree to be bound by the terms of this Legal Notice.

1. Platform Role and Disclaimer

Prosikshya is not a tutoring agency or employer. We are a neutral technology platform that provides listing, profile management, communication, and coordination tools for students and tutors.

We do not monitor or control individual sessions or the academic material shared.

We do not endorse or verify any specific tutor unless explicitly stated on their profile as "Verified by Prosikshya."

We are not a party to any agreements made between students and tutors.

2. Payment Disclaimer

Important Notice Regarding Payments:

Prosikshya does not offer an online payment gateway at this time. Therefore:

All payments must be made directly by students to the tutor’s nominated bank account or digital wallet.

Tutors must clearly communicate their preferred payment method and expectations before starting a session or package.

Students are encouraged to retain screenshots, receipts, or records of payments for reference.

Prosikshya bears no responsibility for:

Delayed or missing payments,

Overpayments or underpayments,

Fraud, scams, or disputes between students and tutors regarding payment,

Services not rendered after payment is made directly.

We strongly discourage advance full payments to tutors without confirming their credibility or starting with trial sessions.

3. Relationship of Parties

All tutors on Prosikshya act as independent service providers.
They are not employees, partners, or representatives of Prosikshya.

Students and tutors are solely responsible for:

Determining if they are a good academic match,

Agreeing on session length, subject scope, pricing, and scheduling,

Managing cancellations, refunds (if any), or changes in learning plans.

Prosikshya does not mediate disputes, although we may remove users who violate community trust or our Code of Conduct.

4. User Obligations

Tutors Must:

Provide accurate and honest information in their profiles,

Disclose payment terms clearly before beginning,

Be punctual and professional during sessions,

Notify students in advance in case of any cancellations or changes.

Students Must:

Review tutor profiles, reviews, or referrals before confirming,

Agree clearly on fees and payment method beforehand,

Attend sessions punctually and respectfully,

Communicate expectations and concerns professionally.

5. Code of Conduct

We expect all users to:

Treat each other with respect and professionalism,

Refrain from harassment, discrimination, or abuse,

Avoid any form of plagiarism or academic dishonesty,

Use the platform only for legitimate educational purposes.

Any reports of misconduct, threats, or inappropriate behavior will be investigated. Prosikshya reserves the right to suspend or ban accounts violating this code.

6. Intellectual Property

All content uploaded by tutors, such as notes, lesson plans, or recorded sessions, remains their intellectual property unless otherwise stated. Students must not distribute or misuse such materials without written permission from the tutor. Prosikshya retains the rights to its own branding, logos, web design, and platform functionality.

7. Limitation of Liability

Prosikshya is not liable for any:

Losses resulting from academic performance or examination results,

Emotional distress due to poor tutor-student match,

Damages from communication or meeting conducted outside the platform,

Technical issues such as connectivity failures or third-party software crashes.

Use of the platform is at your own risk.

8. Suspension & Termination

We may suspend or permanently terminate access to our platform for:

Repeated complaints or disputes,

Fake or misleading profile content,

Solicitation of payments outside agreed terms,

Violation of applicable laws or community standards.

9. Updates to This Notice

This Legal Notice may be updated periodically to reflect changes in our operations, services, or legal environment. Continued use of the platform constitutes your acceptance of the latest version.

10. Governing Law

This Legal Notice is governed by and construed in accordance with the laws of Nepal. Any disputes shall be subject to the exclusive jurisdiction of the courts in that region.
